Dr. Ding Junfeng, Judge from Supreme People's Court, held a lecture in Law School

On October 31, at the invitation of Corporation Law Committee, Civil and Commercial Law Committee and Financial Law Committee of Dalian Bar Association and Law School of Dalian Maritime University, Dr. Ding Junfeng, one of drafters of judicial interpretation of Civil Procedure Law and the judge from trial supervision tribunal of Supreme People's Court came to Dalian Maritime University and held an academic lecture on “Analysis of Difficult Cases on Corporate Finance and Civil and Commercial Matters” to financial, civil and commercial lawyers in Dalian and teachers and students from Law School. Deputy Dean Han Lixin attended this lecture, together with part of Law School teachers and students. The lecture was presided over by Ne Jianhong, Director of Dalian Bar Association Corporation Law Committee, together with Deputy Dean Han.

During the lecture, Dr. Ding explained the origin of difficult cases with a large amount of retrial cases heard by trial supervision tribunal of Supreme People's Court, and told about judgment thinking used by retrial judges while dealing with such cases. Judge Ding pointed out that judgment thinking of judges of different levels differed in longitude, rigidity and latitude, while trial supervision tribunal of Supreme People's Court, on one hand preferred to seek for substantial justice and breakthrough existing rules in retrial cases, and on the other hand, it had to weight the benefits and values constantly, with the hope to create rules to bridge the gap between legal rules and real life. The application of law is not mechanical formal logic inference, only to emphasize on both law and morality, and discover and follow moral concerns in law, can social reality problems be solved practically and effectively, and can society be promoted to develop orderly.

Dr. Ding also expressed his expectation on legal professional community. He hoped that lawyers could seek comprehensively for legal basis that could be applied from the judges’ point of view, and learn how to persuade the judge to make a decision in favor of his party in the interests of all parties. The judge’s first discerning has a decisive influence on the judgment of the case, as a result, law school students can make appropriate judgments during case trial and discover and create new rules only by storing up sufficient professional knowledge and related knowledge.

Dr. Ding explained in simple language but conveyed profound significance, and his lecture gave inspiration to both law learners and law practitioners. The lecture was well received by lawyers, teachers and students participated.

This lecture was an academic exchange activity jointly hosted by Law School and Dalian Bar Association Professional Committee. After the lecture, Deputy Dean Han reached an agreement with directors of relevant Professional Committee of Bar Association, that in order to promote academic communication in legal professional community, and to provide more chances to students from Law School to contact with and integrate into legal professional community, the two parties should establish a long-lasting mechanism on academic resource sharing and teaching practical base assistance.
